GUILTY!!! on three counts *=* LIBEL AND SLANDER *=* occur when a person or entity communicates false information that damages the reputation of another person or entity. Slander occurs when the false and defamatory communication is spoken and heard. Libel occurs when the false and defamatory communication is written and seen. The laws governing libel and slander, which are collectively known as DEFAMATION, are identical. A plaintiff who wishes to sue an individual or entity for libel or slander has the burden of proving four claims to a court: First, the plaintiff must show that the DEFENDANT communicated a defamatory statement. Second, the plaintiff must show that the statement was published or communicated to at least one other person besides the plaintiff. Third, the plaintiff must show that the communication was about the plaintiff and that another party receiving the communication could identify the plaintiff as the subject of the defamatory message. Fourth, the plaintiff must show that the communication injured the plaintiff's reputation. See ya in the news donethat! ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ 2 post: 1 min ago "donethat" my advice to you would be as follows:: Unfortunately, if Larry can prove that you made these defamatory statements and that they were not true, you may find yourself required to pay substantial damages to Larry...dba McCamment's Cattlemens . Depending on your state laws, larry likely will not have to prove that the statements were defamatory, since interfering with a person’s business or trade is usually considered defamation per se. Damages can include actual damages, such as the money he lost as a result of losing business as a result of your statement. You may also have to pay damages for causing his emotional distress, and punitive damages that the court awards to him in order to punish you for making the defamatory statements. You should speak to an experienced personal injury attorney who has handled libel and slander cases in order to determine how you should proceed. In many cases, attempting to settle out of court will be your best bet, but an attorney in your jurisdiction can give you more concrete advice about your potential financial liability in a defamation judgment and how you should proceed to protect yourself from as much financial loss as possible. "WE" all sometimes have an inclination (natural disposition)( to say or do things "WE" shouldn't and after thinking about it, deciding we shouldn't have. An apology on Topix wouldn't hurt anything, the Judge 'might' see it in your favor.

There's totaled "&" then there's totaled! 4/15/2012 - One Killed and One Injured in Ripley County Crash Saturday - Click here to print this information -------------------------------------------------------------------------------- Information from Indiana State Police - Ripley County: Saturday afternoon one person was killed and one injured in a two car crash near the Versailles State Park entrance. According to Trooper Matt Holley at approximately 2:30 afternoon a 2005 Pontiac Grand Prix driven by 23 year old Mark Wesley Brax of Columbia, SC was eastbound on U.S. 50 just east of the entrance to the Versailles State Park when he lost control in the heavy rain and began to skid sideways. The Grand Prix then skidded into the westbound lane when a westbound 2011 Toyota Highlander driven by 35 year old Donielle R. Stewart of Cincinnati, OH struck the Grand Prix broadside on the passenger side causing extensive damage to both vehicles. Brax was pronounced dead at the scene and Stewart suffered compound fractures to her ankles and as well as leg injuries. Tpr. Holley believes Brax was operating his vehicle too fast for the wet road conditions which may have caused him to hydroplane then losing control of his vehicle. Tpr. Holley also commented Brax was a student at the University of Cincinnati. The crash remains under investigation. Tpr. Holley was assisted at the scene by Ripley County Sheriffs deputies, Rescue 69, Ripley County Medic, and the Ripley County Coroners Office.

Secret Service Sex Scandal: President Obama the Pimp? They say that employees look to their boss to determine their behavior and actions. If employees have a lax boss who often breaks the rules in front of them, employee morale and work output will be very low. “Things like this don’t happen once if they didn’t happen before,” said California Rep. Darrell Issa, who leads the House Oversight and Government Reform Committee. It certainly seems as if the Secret Service does not have confidence in their boss, the president.

Nopo has a 'good' cause and I support him:
He went to the IHSAA town hall meeting at Plainfield High School April 17. About sixty people showed up.
HE spoke in favor of the single-class basketball tournament
He's done his part. Its now for others to carry the banner at the Seymour (4/23/12), Milan (5/1/12), and Connersville (5/16/12) meetings.

Sen. Delph Statement on IHSAA High School Basketball Statewide Meetings
Posted by: Mike Delph on Thursday, March 29, 2012 at 6:30:55 pm
•Thank you Bobby Cox and the IHSAA for the invitation to be with you today. My name is Mike Delph. I serve in the Indiana State Senate representing the Westside of Carmel and Indianapolis along with parts of the town of Zionsville. I serve as part of the Majority Caucus leadership team as the Assistant Majority Floor leader for Communications. •Last summer and fall, I asked for legislation to be drafted dealing with an array of education related matters. •Included in the legislation was a provision that would essentially eliminate class basketball. •The Indiana General Assembly has complete authority over all aspects of public education as written in Article VIII of the Indiana State Constitution. •On Organization Day last year, I was asked by the Senate Committee Chairman on Education to explain all provisions of my proposal privately to the Senate Majority Caucus, the Republican Caucus. •I did and afterward we began to see more interest in the issue of basketball. •When my proposal was heard in Committee, there was little debate over the Indiana General Assembly’s authority to act, but much discussion as to whether or not it should exercise that authority. •Commissioner Cox made the case that we should not. Subsequently, a mutual friend reached out to me and asked if I would be willing to engage in a dialogue and discuss further with the IHSAA. •This man was Lee Lonzo, my High School government teacher from many years ago. I did and this led to direct talks with Bobby and the IHSAA. •I am very pleased to be here with Bobby to discuss the fruits of those discussions. •I am very pleased that the IHSAA led by Commissioner Cox has agreed to re-open the discussion of single class basketball. We are going on the road to Milan, to Plymouth, to Gary Roosevelt, to Marion, to Connersville and other points to have a public dialogue on the importance of basketball to the State of Indiana. •We are the land of John Wooden, Bobby Knight, Gene Keady, Brad Stevens, Larry Bird, Oscar Robertson, Bobby Plump, George McGinnis, Calbert Cheney, Glenn Robinson, Kent Benson, Steve Alford, Scott Skiles, Damon Bailey, Jeff Gross, Jay Edwards, Lyndon Jones, Mike and Chris Heinemann, the Zeller brothers, Alan Henderson and I am proud to say Ben Gardner and Yogi Ferrell and many many others. •Basketball is part of the national identity of the State of Indiana. And it must be respected as such. •It is my hope that the public turns out in overwhelming fashion and stands with me and demands that we restore a proud Indiana tradition that made legends and built our identity as a basketball state. •This is not about picking on smaller schools as I understand fully Bobby’s concern. Bright minds should be able to find a path to address that concern. •The Indianapolis Star reported that attendance of this year’s state finals has hit an all-time low since we have gone to class basketball. •It’s time for us to consider a different path, a proven path, a return to single class basketball. •I am counting on the sports media to well publicize these meetings. I intend on being to as many as my private sector schedule allows. But I am counting on the public to have their voice heard. •I asked Bobby what he would do if there was overwhelming response to return to our single class tournament and he said he always encourages his members to listen to their communities. •That’s all we can ask for in this case. •A note to my taxpayers. I will be using my own personal time for this effort and pay for my own expenses. I love Indiana and its many traditions. •I love and respect greatly our Indiana basketball tradition and mystique and will do all within my power to help her shine. •Thank you very much!

Why 'grass' is good for you! According to an approved statement from the US Department of Justice in 1988, "Nearly all medicines have toxic, potentially lethal effects. But cannabis is not such a substance. There is no record in the extensive medical literature describing a proven, documented cannabis-induced fatality. In practical terms, cannabis cannot induce a lethal response as a result of drug-related toxicity."[53] From January 1997 to June 2005, the U.S. Food and Drug Administration (FDA) reported zero deaths caused by the primary use of cannabis. In contrast, common FDA-approved drugs which are often prescribed in lieu of cannabis (such as anti-emetics and anti-psychotics), were the primary cause of 10,008 deaths.[54] Everything in moderation: A 2002 longitudinal study published in the Canadian Medical Association Journal concluded that "marijuana does not have a long-term negative impact on global intelligence", and that "current marijuana use had a negative effect on global IQ score only in subjects who smoked 5 or more joints per week." The study, which monitored subjects since birth, examined IQ scores before, during and after cessation of regular marijuana use. It found current light users and former users showed average IQ gains of 5.8 and 3.5 respectively, compared to an IQ gain of 2.6 for those who had never used cannabis. The study did however show an average IQ decrease of 4.1 for heavy users 'i' rest my case ::abjuration:: "Not for a long-long time" have 'i' " ... but 'i' once did, maybe more than once

Sentimental Journey Les Brown and His Band of Renown, with Doris Day as vocalist, had a hit record with the song, Day's first #1 hit, in 1945. The song's release coincided with the end of WWII in Europe and became the unofficial homecoming theme for many veterans. The recording was released by Columbia Records as catalog number 36769 Here are the famous lyrics as sung by Doris on the 1944 recording: Gonna take a Sentimental Journey, Gonna set my heart at ease. Gonna make a Sentimental Journey, to renew old memories. Got my bags, got my reservations, Spent each dime I could afford. Like a child in wild anticipation, I Long to hear that, "All aboard!" Seven...that's the time we leave at seven. I'll be waitin' up at heaven, Countin' every mile of railroad track, that takes me back. Never thought my heart could be so yearny. Why did I decide to roam? Gotta take that Sentimental Journey, Sentimental Journey home. Sentimental Journey. www.sentimentaljourneydanceband.com/
